TERms and conditions
PAYMENT TERMS: All reservations/ bookings are subject to an $80 Administration Processing Fee (non-refundable). The initial deposit is made up of one-half of the gross rent including cleaning and any additional fees. (Other terms may apply for full-season Agreements.) It is due at the time of booking if booking is through VRBO or SUNSET RENTALS website. Final payment is due thirty (30) days prior to check-in date, and GUEST shall not be entitled to possession unless and until said amount has been paid in full to VRBO or SUNSET RENTALS. If GUEST shall default in any one of the payments for twenty-four (24) hours, the RENTAL MANAGER may, at his or her option, take immediate possession without suit, writ of possession or other legal action, and the GUEST hereby agrees that any deposit or rent payment made up to the time of default shall be forfeited and retained by the RENTAL MANAGER because of the GUEST’S failure to comply with the terms of this Agreement.
CHECK-IN/CHECK-OUT TERMS: Check in time is 3:00pm. RENTAL MANAGER will provide access code to GUEST 1-3 hours prior to check in time. Cleaning may occur as late as 6:00pm on the date of check-in but only in rare situations. Check-out time is 10:00am on the date of departure. The GUEST agrees to give up possession of this property at the termination of this Agreement peaceably and without delay, the execution and delivery being construed as full and sufficient legal written notice to the GUEST to quit or vacate premises immediately upon the termination hereof. The property hereby licensed shall be surrendered up in substantially as good condition as it was at the time GUEST was first entitled to possession under the terms hereof. If GUEST continues to occupy the property past check out time RENTAL MANAGER reserves the right to charge a late check out fee ($50 per 30 minutes).
CANCELLATION POLICY: All reservations are subject to a nonrefundable $80 admin fee. If GUEST cancels 60 days prior to arrival date, then 100% refund will be provided (less $80 admin fee). If the GUEST cancels 30 days prior to arrival date, then 50% refund will be provided (less $80 admin fee). All cancellation requests must be in writing.
REFUNDS: SUNSET RENTALS will not be held accountable for advertising errors due to property owner updates to pricing, availability, furnishings, amenities, equipment, and bedding arrangements. Refunds will not be given due to circumstances outside the control of SUNSET RENTALS. This includes mechanical failure of items such as, but not limited to, air conditioners, TV, internet, kitchen appliances, elevators, and other luxury items. This includes power outages, construction from surrounding areas, acts of nature such as beach or weather conditions, flooding, or high winds. No refunds can be given for any item not brought to our attention prior to your departure.
HOLD HARMLESS & INDEMNITY: OWNER, RENTAL MANAGER or SUNSET RENTAL REPRESENTATIVES shall not be held liable or responsible, in any way whatsoever, for any personal property damage/loss or injuries, bodily or otherwise, that may be incurred or suffered by the GUESTS be it personal injuries, bodily or from pilfering, in or on the rental unit premises during the term of this Agreement. GUEST agrees to hold OWNER, RENTAL MANAGER & SUNSET RENTAL REPRESENTATIVES harmless against any claim for damage and/or injury due to Rental GUEST act or neglect or their guests’ act or neglect. RENTAL MANAGER is not responsible for any actions of other property owners or the homeowner’s association (HOA).
LODGING TERMS: It is understood, mutually agreed and acknowledged by the parties to this Agreement that:
a. RENTAL MANAGER, or SUNSET RENTAL representatives and employees may enter upon the rental premises with 4-hour notice, at their sole discretion, for the purpose of inspection, maintenance or repairs; and between the hours of 10:00am – 6:00pm on the date of check-in for the purpose of cleaning.
b. The Property must be occupied by the GUEST identified in this Agreement, over the age of 25 and all occupants of the premises shall be supervised by that GUEST for the entire duration of the rental period. The occupancy shall not exceed the number of persons identified in “maximum occupancy.” GUEST agrees that this Agreement may not be assigned or sublet for any reason.
c. GUEST acknowledges that he/she has personally viewed the property online and accepts it in an “as-is” condition. If GUEST has not viewed the property, he/she waives the right to withhold rent for any alleged deficiency in the premises or to otherwise claim that the property has been misrepresented to him/her by the RENTAL MANAGER.
d. RENTAL MANAGER may terminate this Agreement and remove all GUESTS at anytime if, at the sole discretion of RENTAL MANAGER, GUEST becomes objectionable, violates any terms of this Agreement, violates any of the community HOA rules and regulations, or has created a disturbance of the peace that has been reported to RENTAL MANAGER, or Police. In such event, GUEST agrees to immediately vacate the property, at RENTAL MANAGER’S request, without a refund.
e. The operation, maintenance, opening, closing and lifeguard coverage for any complex supplying a swimming pool will not be guaranteed by the RENTAL MANAGER.
f. Utilities are included in the rental price unless specified elsewhere in this Agreement. GUESTS are prohibited from charging movies and/or shows to OWNERS cable accounts.
g. RENTAL MANAGER reserves the right to cancel this Agreement at any time prior to GUEST taking occupancy of the property. In such event, GUEST will be refunded all monies received.
h. The GUEST maintains a permanent residence elsewhere and acknowledges that this is a transient lodging; therefore, terms of this Agreement are not governed by the Delaware Landlord Tenant Code.
i. Notwithstanding any other assurances to the contrary, this Agreement is not legally binding or effective until signed by the GUEST & RENTAL MANAGER and deposit is received.
ITEMS PROVIDED: Where the OWNER provides a grill, TVs, dishwasher, microwave, stove/oven, refrigerator, washing machines, dryers, elevator or icemakers, it is as a courtesy only. Repair or replacement during the terms of this Agreement is not guaranteed. RENTAL MANAGER will make every effort to have item repaired in a timely manner. Bed covers, pillows, mattress covers, and extra blankets are included with each rental unit. Some rental units also provide beach chairs, umbrellas, sand toys and boogie boards. The RENTAL MANAGER does not guarantee any of these items as GUESTS will damage or break and not report to us. Please refer to the property Welcome Letters for additional information.
ITEMS NOT PROVIDED: Bed sheets, pillowcases, towels, beach towels, soap and paper products are not included. GUESTS may bring their own or rent from local linen rental companies. Please refer to the property Welcome Letters for additional information.
HOUSEKEEPING: Rental units are cleaned in between GUEST departure and arrival times on check out day. The cleanings are standard rental cleanings and not meant to be deep spring cleanings. GUESTS are responsible for the cleaning of rental unit during stay and for leaving the unit in good condition at check-out. We respectfully request GUESTS acknowledge they are staying in someone’s home during their vacation; please treat it with the care you would your own. RENTAL MANAGER reserves the right to assess additional cleaning fees if GUEST vacates property in a condition that requires over and above the standard rental cleaning.
LOST & FOUND: SUNSET RENTALS are not responsible for items left behind. Please contact us within 48 hours of departure if you think you may have left items at the rental unit. SUNSET RENTALS reserves the right to charge $75/hr for time spent mailing items back plus any associated shipping costs.
PET POLICY: Only a few of our properties allow pets. It is GUEST’s responsibility to make sure you rent a pet-friendly rental unit. if you are planning to bring a pet. A non-refundable pet fee will apply. Violators of this policy will be subject to immediate eviction without refund of occupancy fee or damage deposit. Fines will apply. Any pet that constitutes a nuisance or causes damage as determined by the RENTAL MANAGER will not be permitted to remain on the premises. GUEST agrees to keep the pet under leash at all times when outside the rental unit and will curb their pet away from the neighbor’s property and in such a manner as to not constitute a nuisance to others. GUEST will be responsible for the cost of all repairs necessitated by damage done by the pet both in the house and on the grounds.
REPAIRS & SERVICE CALLS: RENTAL MANAGER will respond back to repairs & service calls in the order they are received and prioritize urgent issues. We cannot guarantee against the breakdown of air conditioning, elevators or other appliances. Please report any non-operative equipment to our office promptly. We will make every effort to have repairs done quickly and efficiently. Should a repairman make a call to a rental unit and find that the equipment is in working order and the problem was due to GUEST oversight or neglect, the charge for the service call will be accessed to GUEST. No rental refunds will be made due to the failure of air conditioning, elevators, pools, hot tubs, and other appliances or items beyond our control.
HOMEOWNER’S & CONDO ASSOCIATION RULES: Rental Guest understands that they are in a property governed by the Community Homeowners’ Association (HOA) Covenants. By staying at in a property in the community, the GUEST agrees that (i) everyone in their rental group will abide by all provisions of the Declaration, The Certificate of Incorporation, Bylaws and Rules and Regulations of the Association and the Community Clubhouse and (ii) Agrees that the Association shall have the right, in addition to all other rights provided by the Act and any other applicable Laws, to terminate the lease (without any refund to the GUEST) upon default by the GUEST in observing any of the provisions of the Declaration, Certificate of Incorporation, Bylaws and Rules. A full copy of the Declaration of Covenants and Bylaws can be provided upon request. GUESTS are responsible for any fine assessed by HOA to OWNER or RENTAL MANAGER due to GUEST conduct or actions during their stay.
COMMUNITY AMENITY ACCESS & PARKING: Properties located within HOA communities may include amenity access with the rental property. Access to community amenities is through a variety of devices (key fob, badge, wrist band, key etc) please refer to property binder for access information. In addition, some communities/ properties may provide or require parking passes for GUESTS. RENTAL MANAGER reserves the right to charge GUEST replacement costs for any device or parking pass not returned or lost during the GUEST stay.
SMS MESSAGES: By completing the reservation of the rental property with SUNSET RENTALS you consent to having SMS messages sent, for reservation information purposes only, to the cell phone number that has been provided in the reservation.
